His government tried without success to get a bill opening up the squatters' land to farmers through the Legislative Council. Nicholson resigned in November 1860 and was succeeded by Richard Heales, who had emerged as the leader of the more advanced democrats. He also battled in vain against the Council, and in August 1861 he obtained a dissolution. He fought the election on a policy of reducing the power of the Council.
